Terms & Condition of Sale

These Terms & Conditions of Sale govern the purchase of products (“Products”) from House of Thavy LLC (“House of Thavy,” “we,” “us,” “our”) on our website and related services (the “Site”). By placing an order, you agree to these Terms & Conditions of Sale, our Website Terms of Use, our Privacy Policy, and our Returns Policy (together, the “Terms”).

1. Important legal notice

Please read these Terms carefully before ordering. They explain who we are, how we supply products, what to do if there is a problem, and other important information. By submitting an order, you confirm that you accept these Terms.

BINDING ARBITRATION; CLASS ACTION WAIVER; JURY TRIAL WAIVER.
Except for certain types of disputes described in Section 19, disputes between you and House of Thavy will be resolved by binding arbitration on an individual basis. Unless you opt out within 30 days, you waive the right to bring or participate in a class action, and you waive the right to a jury trial. See Section 19.

2. Information about us

The Site is operated by House of Thavy LLC, a Pennsylvania limited liability company.

3. Products

3.1 Images and colors. Product photos are for illustration. We make reasonable efforts to display colors accurately but cannot guarantee device displays.
3.2 Measurements. Sizing and measurements are approximate. Handmade items may vary by ±1–2 cm.
3.3 Handmade character. Many Products are artisan made in Cambodia; minor variations in motif, weave, trim, or finish are normal.
3.4 Personal use. Products are sold for domestic, private use only and are not for resale or commercial use.
3.5 Age. We sell to U.S. customers 18+ (or with a parent/guardian).

4. Availability

4.1 U.S. only. We accept orders with delivery addresses in the United States.
4.2 Limits. We may refuse or cancel orders for reasons including stock issues, suspected fraud, errors in price/description, or policy violations.
4.3 Changes to Terms. We may update these Terms. The version posted at the time you place your order applies to that order.

5. Your status

You confirm that:
(a) you are 18+ and legally able to enter a binding contract (or have parental involvement);
(b) you are an authorized user of the payment method; and
(c) your delivery address is in the United States.

6. How the contract is formed

6.1 Order acknowledgment. After checkout you will receive an email acknowledging receipt. This is not acceptance.
6.2 Acceptance. Your order is accepted when we send a Dispatch Confirmation email. A contract is then formed.
6.3 Processing. We begin processing promptly. You may not be able to change or cancel after the two-hour window (see Section 9).
6.4 Language. Contracts are in English. Please save a copy of your order and these Terms.

7. Delivery

7.1 Timing. We aim to dispatch by the date shown in your Dispatch Confirmation or as soon as reasonably possible and no later than 30 days from contract formation.
7.2 Completion. Delivery is complete when Products are delivered to the address you provided. Risk of loss passes at delivery to the carrier.
7.3 Multiple shipments. Orders may ship in more than one parcel at no extra shipping charge.
7.4 Service area. Zip code restrictions may apply. We do not ship outside the U.S.

8. Price and payment

8.1 Prices. Prices are in USD and may change without notice before you place an order.
8.2 Taxes. Estimated taxes at checkout may differ. Exact taxes are calculated at shipment based on destination.
8.3 Payment methods. We accept major cards and digital wallets offered at checkout, Shop Pay, PayPal, Apple Pay, Google Pay, and “buy now, pay later” options such as Afterpay and Klarna (subject to provider approval).
8.4 Authorization. By submitting an order, you authorize us to charge your selected payment method for the total amount. Third-party providers’ terms apply.
8.5 Errors. If a pricing or other error is obvious and could reasonably be recognized as an error, we may cancel the order, refund amounts paid, and request return of any Products supplied.
8.6 Discount codes. Enter codes at checkout. One promo code per order unless stated otherwise. Codes may have additional terms and may expire.

9. Returns, refunds, cancellations

9.1 Return window. Returns accepted within 14 days of delivery for unused items in original condition with tags and packaging.
9.2 Refund method. Refunds are issued as store credit only. We do not offer exchanges or cash/card refunds.
9.3 Final sale. Custom or made-to-measure items, earrings, headpieces, and hygiene-sensitive items are final sale.
9.4 Faulty items. Report faults within 7 days of delivery with photos/video and your order number. We will review and remedy as appropriate.
9.5 Cancellations. You may request cancellation or changes within 2 hours of purchase. After that, we cannot guarantee changes.
9.6 Return shipping. Unless the item is confirmed faulty, you are responsible for return shipping costs.

9.7 Fair Usage Policy (returns abuse)

To protect our community, we monitor for unusual return behavior including, without limitation: excessive returns, items worn/used and returned, missing components, mismatched orders, habitual “not received” claims, and patterns inconsistent with normal consumer use. We may: (a) refuse returns, (b) suspend or close accounts, (c) require customer-paid return shipping, and/or (d) decline future orders. This does not affect your statutory rights.

10. Our rights to cancel

We may cancel an order and refund amounts paid if: (a) payment fails; (b) you do not provide required information; (c) you are unavailable or fail to take delivery; (d) the Product is unavailable; or (e) Section 8.5 applies.

11. Inaccurate, incorrect, or damaged Products

We strive for accuracy but do not warrant that descriptions, photography, or measurements are error-free. If your Product is damaged or not as described, contact us promptly and follow the Returns Policy.

12. Promotions and gift cards

Promotions are subject to posted terms and may change or end without notice. Only one promotion per order unless stated. Gift cards are not currently available.

13. Third-party payment programs

When you select a third-party payment method (e.g., Afterpay or Klarna), your use of that service is governed by that provider’s terms and privacy policy. Approval decisions are made by the provider, not House of Thavy.

14. Intellectual property

All intellectual property rights in the Site and Products (including designs, images, text, trademarks, and logos) are owned by or licensed to House of Thavy. You may not copy, modify, distribute, or exploit any content without our written permission.

15. User content and reviews

If you submit reviews, photos, or other content, you grant House of Thavy a non-exclusive, royalty-free license to use, reproduce, and display such content for marketing and customer experience, subject to our Privacy Policy. Do not submit unlawful, infringing, or misleading content.

16. Prohibited uses

You agree not to misuse the Site, interfere with security, attempt to scrape or harvest data, or use the Site for any unlawful purpose. Products are not sold for export or resale.

17. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including but not limited to strikes, labor issues, natural disasters, epidemics, war, terrorism, government actions, carrier or telecommunications failures. We will notify you where reasonably possible and perform once the event ends.

18. U.S. compliance; California notices

18.1 U.S. only. You agree not to export or re-export Products in violation of U.S. laws.

19. Dispute resolution; binding arbitration; class action and jury waiver

PLEASE READ CAREFULLY. This Section affects your rights.

19.1 Informal resolution. Before initiating arbitration or small claims, you agree to email legal@houseofthavy.comwith your name, contact information, order number, and a description of the dispute so we can try to resolve it within 30 days.

19.2 Agreement to arbitrate. Except for the small-claims option below, any dispute, claim, or controversy arising out of or related to these Terms or your purchase will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA)governs the interpretation and enforcement of this Section.

19.3 Small claims. Either party may bring an individual claim in a U.S. small claims court in the county of your residence if the claim qualifies.

19.4 No class actions; jury waiver. Arbitration will be on an individual basis only. Class, collective, consolidated, or representative actions are not permitted. The arbitrator may award relief only to the individual party. If a claim proceeds in court rather than arbitration, both parties waive any right to a jury trial.

19.5 Arbitration process. For claims of $10,000 or less, you may choose a document-only, telephonic, or in-person hearing. For larger claims, the AAA rules apply. The venue shall be Philadelphia County, Pennsylvania, unless you request your county of residence.

19.6 Fees. AAA rules govern fees. We will pay the business portion of AAA filing, administration, and arbitrator fees for non-frivolous claims.

19.7 Severability; opt-out. If any part of this Section is found unenforceable as to a particular claim, that claim shall proceed in court; the remainder will be enforced in arbitration. You may opt out of arbitration and the class action waiver by emailing optout@houseofthavy.com within 30 days of your first purchase, stating your name, email, and a clear request to opt out.

20. Indemnification

You agree to indemnify and hold harmless House of Thavy LLC and its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, misuse of the Site, violation of law, or infringement of third-party rights.

21. Limitation of liability

To the fullest extent permitted by law, House of Thavy LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, or goodwill; or business interruption. Our total liability for any claim relating to a Product shall not exceed the amount you paid for that Product. This Section does not limit liability that cannot be limited by law.

22. Privacy and data

Your purchase and account information are processed in accordance with our Privacy Policy.

23. Other important terms

23.1 Communications. We may contact you by email, phone, mail, or via your account based on the information you provide.
23.2 Assignment. We may assign our rights and obligations. You may not assign without our consent.
23.3 Third-party rights. No third party has rights under these Terms.
23.4 Severability. If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
23.5 No waiver. A failure to enforce any provision is not a waiver of that or any other provision.
23.6 Entire agreement. These Terms, together with the policies referenced, are the entire agreement regarding your purchase.

24. Governing law and venue

Except for the FAA governing arbitration, these Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts rules. For claims that proceed in court, the exclusive venue is the state and federal courts located in Philadelphia, Pennsylvania, and you consent to personal jurisdiction there.
